Permanent Resident Status

On Immigration to Canada, residents of alien countries acquirepermanent residency of this country after undergoing the immigration process. A temporary visitor like an international student or worker or a refugee claimant cannotsaid to be a permanent resident.

On acquisition of PR status, one becomes eligible and authorized to live, to work and to study anywhere in Canada as long as one maintains the as per the laid down requirements. Permanent resident status gets renewed every five years. However PermanentResidents are entitled to renew their permanent resident status if they:

  • Are residents in Canada permanently.
  • Meet the residency obligations, of being present in Canada physically for at least two years in a five-year period. However certain exceptions to meet residency obligation are also available;

  • Permanent residents can count the days outside of Canada:

    • o If they have accompanied a Canadian citizen who is their spouse, common law partner or parent (if PRs are under 22 years of age).
    • o If they have accompanied a permanent resident of Canada who is their spouse, common law partner or parent (if PRs are under 22 years of age) and that person is employed on a full-time basis by a Canadian business or in the public service of Canada or of a province or territory during the time PRs accompanied them.
    • o If they are employed by a Canadian business or the public service of Canada or a province or a territory and are assigned a full-time position outside Canada or to a client or an affiliate of the Canadian business or the public service outside Canada, but they need to be working with the employer in Canada after the assignment.
  • Submit their renewal application in Canada itself.

Renewalentitles an applicant to be issued a PR Card which is usually valid for next five years. Permanent residents become eligible to apply for Canadian Citizenship subject to fulfilment of certain conditions.

Permanent residents are entitled to obtain most social benefits that Canadian citizens receive, including health care coverage. They enjoy same protection under Canadian law and the Canadian Charter of Rights and Freedoms as Canadian citizens do. Permanent residents must pay all applicable taxes and respect all Canadian laws at the federal, provincial and municipal levels However they are not allowed to run for political office and hold jobs that require high-level security clearance.

Permanent resident status is not deemed to have lost upon expiry of PR card. PR status is said to have been lost after the observance or occurrence of following eventuality:

  • Voluntarily renouncement of permanent resident status by a permanent resident.
  • A removal order is made against a Permanent Resident and comes into force.
  • Permanent Resident acquires Canadian citizen.

The permanent resident (PR) Card:

PR card is a proof of one’s permanent resident status in Canada. when permanent residents happento travel outside Canada, they are required to display their card and passport wherever required.

In the absence of a valid PR card, or Permanent residents who are not carrying it, need to apply for a permanent resident travel document before returning to Canada by commercial vehiclepassage.

PR card can be renewed if expired or nine months before the date of expiration. In case of loss, damage or theft, a replacement PR card can be applied for.
